SECTION 1 – WHAT DO WE DO WITH YOUR INFORMATION?
When you purchase something from Prestige Kente, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.
When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.
Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates.
SECTION 2 – CONSENT
How do you get my consent?
When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.
If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.
How do I withdraw my consent?
If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at anytime, by contacting us at info@prestigekente.com.

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.
SECTION 4 – HOSTING
Our website is hosted on Hostinger International Ltd. They provide us with the secure web hosting and server infrastructure that enables us to operate our online store and offer our products and services to you.
Your data is stored through Hostinger’s data storage and databases, as well as our WordPress content management system and WooCommerce e-commerce platform. All data is stored on secure servers protected by firewalls and advanced security measures.
PAYMENT: When you make a purchase through our store, payment processing is handled securely by our third-party payment gateway Paystack.
We do not store your full credit card or payment information on our servers. Your payment data is encrypted and processed directly by the payment provider in compliance with the Payment Card Industry Data Security Standard (PCI-DSS).
Your transaction data is retained only as long as necessary to complete the transaction and comply with legal and accounting requirements.
All payment gateways we use adhere to the standards set by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, MTN MOMO, Telecel Cash and AirtelTigo Cash. These standards help ensure the secure handling of payment information by our store and its service providers.

SECTION 5 – THIRD-PARTY SERVICES
In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.
However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.
For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.
In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.
As an example, if you are located in NIGERIA and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.
DISPUTE RESOLUTION:
In the event of any dispute, claim, or controversy between you and Prestige Kente, or between you and any third-party service provider acting on our behalf (including mobile messaging or payment service providers), arising out of or relating to this Agreement, our services, or any related transaction, both parties shall first make a good-faith effort to resolve the matter amicably through negotiation.
If such attempts fail, the dispute shall be referred to arbitration in accordance with the provisions of the Arbitration Act, 2010 (Act 798) of the Republic of Ghana. The arbitration shall take place in Accra, Ghana, before a single arbitrator mutually agreed upon by both parties. Where the parties fail to agree on an arbitrator, one shall be appointed by the Ghana Arbitration Centre.
The arbitration proceedings shall be conducted in the English language, and the decision of the arbitrator shall be final and binding on all parties. Each party shall bear its own costs and an equal share of the arbitration fees unless the arbitrator decides otherwise.
Nothing in this section shall prevent either party from seeking interim relief or injunctions from a court of competent jurisdiction in Ghana to preserve rights or prevent irreparable harm pending the outcome of arbitration.
This arbitration provision shall survive the termination of your relationship or agreement with Prestige Kente.
MISCELLANEOUS:
You represent and warrant that you have the full legal capacity and authority to agree to these Terms and perform your obligations hereunder. Nothing contained in this Agreement shall put you in breach of any other legal or contractual obligation.
Failure by either party to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. If any provision of this Agreement is found to be invalid or unenforceable under Ghanaian law, such provision shall be modified or limited to the minimum extent necessary so that the remaining terms remain in full force and effect.
Prestige Kente reserves the right to update or modify this Agreement from time to time. Any significant changes will be communicated through our website or other official channels. By continuing to use our services after any such updates, you agree to the revised terms.
